Terms of Service

Please read these terms carefully before engaging our construction and engineering services.

1. Acceptance of Terms

By accessing our website, requesting quotes, or engaging Group Four Engineering & Contracting ("we," "our," or "us") for construction services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website.

These terms constitute a legally binding agreement between you and Group Four Engineering & Contracting, located in Jdeïdé, Lebanon. By signing a construction contract or accepting a proposal from us, you acknowledge that you have read, understood, and agree to these terms.

2. Services Description

Group Four Engineering & Contracting provides construction, engineering, and project management services including but not limited to:

  • Residential construction (villas, apartments, custom homes)
  • Commercial construction (offices, retail centers, mixed-use developments)
  • Design and build services
  • Project management and consulting
  • Renovation and expansion projects
  • Structural engineering and planning

All services are subject to the execution of a separate construction contract that will specify project scope, timelines, pricing, and specific terms for that project.

3. Client Obligations

As a client engaging our services, you agree to:

  • Provide accurate and complete information about project requirements, site conditions, and legal permissions
  • Obtain necessary permits, approvals, and legal authorizations before construction begins
  • Ensure clear and unencumbered access to the construction site
  • Make timely payments as outlined in the project contract
  • Respond to design approvals, change orders, and project decisions within agreed timeframes
  • Inform us of any underground utilities, hazards, or site-specific risks

Failure to meet these obligations may result in project delays, additional costs, or termination of services.

4. Contracts and Payments

4.1 Project Contracts

All construction work requires a signed contract that will include:

  • Detailed scope of work and specifications
  • Project timeline and milestones
  • Payment schedule and terms
  • Warranty terms and conditions
  • Change order procedures

4.2 Payment Terms

Standard payment terms are as follows unless otherwise specified in your contract:

  • Initial deposit: 20-30% upon contract signing
  • Progress payments: Based on completed milestones or monthly billing
  • Final payment: Due upon substantial completion and handover

All payments must be made within 14 days of invoicing. Late payments may incur interest charges of 1.5% per month on outstanding balances. We reserve the right to suspend work for non-payment after 30 days.

5. Project Timelines and Delays

Project timelines are estimates based on normal working conditions and are specified in individual contracts. We are not responsible for delays caused by:

  • Force majeure events (natural disasters, war, civil unrest, pandemics)
  • Weather conditions unsuitable for construction
  • Delays in obtaining permits or approvals from authorities
  • Client-requested changes or design modifications
  • Delayed payments from the client
  • Unforeseen site conditions (rock, unstable soil, hidden utilities)
  • Material shortages beyond our control

In case of delays, we will provide revised timelines and maintain open communication about project status.

6. Change Orders and Modifications

Any changes to the original scope of work must be requested in writing and approved through our formal change order process. Change orders may affect:

  • Project pricing (additional costs or credits)
  • Completion timelines
  • Material specifications

Work on change orders will not commence until the change order is signed by both parties and any additional deposits are received.

7. Warranties and Quality

We stand behind the quality of our workmanship with the following warranties:

  • Structural Warranty: 10 years on structural elements (foundations, load-bearing walls, roof structures)
  • Workmanship Warranty: 2 years on general construction work
  • Systems Warranty: 1 year on MEP (Mechanical, Electrical, Plumbing) installations

Warranties cover defects in materials and workmanship under normal use. They do not cover damage from misuse, neglect, natural disasters, or unauthorized modifications by third parties.

8. Insurance and Liability

8.1 Our Insurance

We maintain comprehensive insurance coverage including:

  • General liability insurance
  • Professional indemnity insurance
  • Workers' compensation insurance
  • Construction all-risk insurance (where applicable)

8.2 Limitation of Liability

To the maximum extent permitted by Lebanese law, our liability is limited to the total contract value for the specific project. We are not liable for:

  • Indirect, consequential, or special damages
  • Loss of profits, business interruption, or reputational damage
  • Claims arising from client-supplied materials or designs
  • Issues arising from pre-existing site conditions not disclosed to us

9. Intellectual Property

All architectural drawings, engineering plans, 3D renderings, and design documents created by Group Four remain our intellectual property until final payment is received. Upon full payment, clients receive a license to use these documents for the specific constructed project.

Clients may not use our designs for other projects, sell them to third parties, or reproduce them without written permission. All website content, photos, and project case studies are our property and may not be used without authorization.

10. Termination

Either party may terminate the construction contract under the following conditions:

  • By Client: With 30 days written notice, subject to payment for all work completed and materials procured up to termination date
  • By Us: For non-payment, failure to provide site access, or breach of contract terms, with 14 days written notice

Upon termination, the client must pay all outstanding amounts for work completed, materials purchased, and demobilization costs.

11. Dispute Resolution

We aim to resolve all disputes amicably through negotiation. If disputes cannot be resolved through discussion, the parties agree to:

  • Mediation through the Lebanese Contractors Association or similar professional body
  • Binding arbitration in Lebanon if mediation fails
  • Arbitration to be conducted in Arabic or English as agreed

Legal proceedings will be governed by Lebanese law and conducted in the courts of Beirut, Lebanon.

12. Governing Law

These Terms of Service and any construction contracts are governed by the laws of the Republic of Lebanon. Any legal disputes arising from our services will be subject to the exclusive jurisdiction of Lebanese courts.

13. Website Usage

By using our website, you agree to:

  • Use the site for lawful purposes only
  • Not attempt to breach security or access restricted areas
  • Not use automated systems (bots, scrapers) to extract data
  • Respect intellectual property rights of all content

We reserve the right to block access to users violating these terms or engaging in malicious activity.

14. Third-Party Links

Our website may contain links to third-party websites (social media, suppliers, government portals). We are not responsible for the content, privacy practices, or terms of these external sites. Accessing third-party links is at your own risk.

15. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised terms. Project-specific contracts will govern individual projects according to the version of terms in effect at contract signing.
